Welcome to NuevoTrends, an influencer marketing platform (A Venture of Nuevo Gadgets). These Terms and Conditions govern the use of our services by both Brands and Influencers. By accessing or using our platform, you agree to be bound by these terms.

1. Definitions

• Platform – The technology infrastructure, including web and mobile services, operated by NuevoTrends.

• Brand – A business or representative engaging Influencers through the platform to promote products or services.

• Influencer – A content creator registered on NuevoTrends to execute brand campaigns.

• Campaign – Any marketing task (online/offline) executed through content such as Reels, Shorts, Stories, etc.

• Wallet – NuevoTrends internal payment management system for Influencer payouts.

2. General Terms (Applicable to All Parties)

• All parties must create a valid account with accurate information.

• Misuse, impersonation, or fraudulent activities will result in immediate termination.

• Communication and transactions must be routed through the platform unless approved in writing.

• NuevoTrends reserves the right to suspend, block, or blacklist any user at its discretion.

3. Terms for Brands

• Brands must issue clear, written campaign briefs with timelines, objectives, and deliverables.

• Full or partial campaign payments are to be made in advance for campaign activation.

• Brands are prohibited from directly hiring or contacting influencers post-campaign without NuevoTrends’ consent.

• All content rights and licensing must be defined within each brief.

Cancellation Policy (For Brands):

• If the campaign is canceled after confirmation but before execution, the brand is liable to pay 40% of the campaign fee to cover creator booking.

4. Terms for Influencers

• Influencers must respond professionally to briefs and timelines.

• All created content must be original and compliant with laws and platform standards.

• Content must remain live for at least 180 days unless agreed otherwise.

Communication Clause:

• Influencers must not contact the brand directly without written permission from NuevoTrends.

• Violation may result in termination, forfeiture of payment, and legal recourse.

Payment Terms:

• Influencers will receive 80% of the campaign fee. NuevoTrends retains a 20% commission.

• Payout structure:

  • 40% advance on confirmation

  • 60% post content approval and publishing

• All payouts will be processed through the NuevoTrends Wallet with withdrawal option upon request.

No-Show Clause:

• First No-Show: Warning + up to 10% deduction

• Repeated No-Show: Up to 25% penalty or blacklist

• Valid emergencies will be reviewed on a case-by-case basis.

Final Deadline Clause:

• 24-hour grace period may be granted with prior notice.

• Beyond that, 10% deduction per day of delay.

• Failure to deliver within 3 days = No payout + campaign cancellation.

5. Content Ownership & Usage

• Influencers grant a non-exclusive, global, royalty-free license to NuevoTrends and the Brand to use content for marketing, advertising, and PR.

• Rights do not transfer unless separately agreed.

6. Confidentiality & Data Use

• All briefs, communication, pricing, and campaign-related data are confidential.

• Users may not share, publish, or resell confidential materials or data.

7. Platform Rights

• NuevoTrends may showcase campaign case studies (without pricing) for portfolio use.

• We reserve the right to update platform terms with prior notification.

8. Dispute Resolution

• Any disputes must first be discussed in good faith for resolution.

• Legal matters will fall under the jurisdiction of Pune, Maharashtra, governed by Indian Law.
